Please note: This is the only time of year that you can sign up for health insurance or change plans unless you have a qualifying event (new baby, marriage, etc.)

Summary of Benefits and Coverage (SBC) – Affordable Care Act Requirement

As part of the Affordable Care Act (ACA), employers are required to provide a Summary of Benefits and Coverage (SBC) to all employees who are eligible for group health insurance. The SBC uses a standardized federal template designed by the Department of Health and Human Services (HHS) to make it easier for individuals to understand their coverage and compare plan options.

What Employers Need to Know

  • The SBC must be distributed to all eligible employees, not just those who are currently enrolled.
  • It must be provided:
    • When an employee first becomes eligible,
    • During annual open enrollment,
    • Within seven business days of a request, and
    • Within 60 days if there are material changes to the plan.
  • Employers should review the SBC carefully before distribution to ensure it matches the benefits package offered.

Why It Matters

Failure to provide the SBC can result in significant penalties. As of 2025, fines may be up to $1,700 per employee per failure, with additional penalties possible under federal and state law.

What Employees Can Expect

Eligible employees will receive an SBC along with other important details about their health insurance, such as employee contribution levels and enrollment instructions. This ensures that every employee has the information they need to make an informed decision about their health coverage.
